Why hire a Certified Access Specialist (CASp) in LA?

Legal Benefits

Improved Accessibility for Everyone

Minimize Lawsuit Risk

With the completion of a CASp Inspection, you are recognized as a 'qualified defendant.' This status allows for the reduction of statutory damages to a minimum of $1,000 for each occasion by the plaintiff if you can prove that all construction-related violations that were the basis of the claim were corrected within 60 days of being served with the complaint. Furthermore, qualifying small businesses that utilize our ADA consultant services, including hiring our CASp inspectors, may take advantage of a 120-day grace period. During this time, they are exempt from liability for statutory damages related to those violations identified in the CASp report, provided they are rectified within the 120-day timeframe. It's important to note that only a certified access specialist can provide services that grant 'qualified defendant' status.

In contrast, without a CASp Inspection, you may face statutory damages of $4,000 per occasion under Civil Code section 55.56. If found liable, you could also be responsible for the plaintiff's attorney fees in addition to these statutory damages.

Minimize Lawsuit Risk

Improved Accessibility for Everyone

Minimize Lawsuit Risk

Upon completion of a CASp inspection in accordance with the Construction Related Accessibility Standards Compliance Act (CRASCA), you will be issued a Disability Access Inspected Certificate (DAIC) from your ADA consultant services. Posting a copy of this certificate in a visible location may deter individuals seeking out your business as 'low-hanging fruit' and help prevent you from being identified as an easy target for a construction-related accessibility lawsuit.

Displaying a DAIC does not indicate that your business is non-compliant; rather, it showcases that you are a responsible business owner who has taken initiative and is ahead of potential litigation. Furthermore, if you were to face a lawsuit after completing a CASp inspection with the help of ADA inspectors, you could demonstrate that you have been making necessary repairs and upgrades, which may lead to the lawsuit being dismissed.

Improved Accessibility for Everyone

Improved Accessibility for Everyone

Improved Accessibility for Everyone

Accessibility improvements don't just benefit individuals with disabilities; they also enhance the experience for everyone. For instance, pushing a stroller up a ramp is significantly easier than hauling it up a flight of stairs. While that ramp was installed to comply with the ADA and California Building Code, it's accessible to all, showcasing the principle of 'Universal Design.' Engaging ADA consultant services and ADA inspectors can ensure that such features meet necessary standards.

Moreover, it's important to remember that life is unpredictable. Any one of us could face an accident that leaves us temporarily or permanently disabled. If you imagine yourself in that situation, you'd surely appreciate an establishment that adheres to ADA regulations and the California Building Code. Consulting with a CASP consultant or undergoing a CASP inspection can further ensure compliance, making public spaces safer and more welcoming for everyone.
